Terms & Conditions — International Moving & Destination Services

1. Scope of Agreement

These Terms & Conditions (“Terms”) apply to all international household goods, personal effects, and destination services provided by Metropolitan Logistics Inc. (“Company”). By booking, the client (“Client”) agrees to these Terms. Any amendments must be confirmed in writing by the Company.

2. Quotes, Estimates & Payments

  • Basis of Estimate: Estimates are based on declared or surveyed volume/weight, access conditions, and current carrier/terminal tariffs.

  • Adjustments: Final charges may change if actual shipment volume/weight differs, or if additional services (e.g., shuttle, storage, demurrage, re-delivery, extra handling) are required.

  • Unless states other wise quotes are valid for 60 days only!

3. Cancellation Policy

  • 2–0 days or no-show: 30% of contract + incurred third-party costs

4. Access & Site Conditions

  • Client must ensure safe, legal access at both origin and destination (parking permits, elevators reserved, pathways cleared, winter driveways salted).

  • Shuttle trucks, cranes, long carries, or warehouse handling may be required at extra cost if direct container/trailer access is not possible.

  • Parking fines or building penalties due to lack of preparation are charged to the Client.

5. Customs, Compliance & Documentation

  • Client must provide all required documents (e.g., visas, residency permits, IDs, detailed inventories) in a timely manner.

  • Duties, taxes, inspection/exam fees, and customs penalties are the Client’s responsibility.

  • Company provides a standard inventory and bill of lading. Countries that require per-box itemized inventories may incur extra preparation fees.

  • Prohibited/restricted items must not be included; see Section 12.

6. Transit Times & Carrier Schedules

  • Transit times are estimates only and subject to carrier availability, consolidation schedules, weather, strikes, congestion, and customs inspections.

  • Company is not liable for costs due to delay unless a written service level agreement (SLA) guarantees otherwise.

7. Packing, PBO & Special Items

  • Company packs/export-wraps furniture, large pictures, and fragile items.

  • PBO (Packed by Owner) cartons/items are carried at released liability only and excluded from All-Risk insurance.

  • Fragile or high-risk items (marble, glass, fine art, antiques, collections) may require custom crating; if declined, items move at Client’s risk.

8. Liability, Valuation & Insurance

8.1 Released Liability (Default)

  • If no insurance is purchased, Company’s liability is limited to CAD/US $0.60 per pound per article.

     

  • This is not insurance and typically does not reflect replacement cost.

     

8.2 Declared Valuation

  • Clients may declare a higher shipment value for additional cost.
    This is not an insurance policy but sets a higher maximum Company liability.

     

  • Settlement is based on repair, replacement, or current market value at time of loss, not original purchase price or sentimental value.

     

8.3 Transit Insurance (All-Risk, Recommended)

  • Comprehensive “All Risks” coverage is available through Inter Trans Insurance Services / Roanoke / HDI Global Insurance Company.

     

  • Covers loss/damage from external causes during international transit, subject to policy terms & exclusions (including pairs & sets, high-value declarations, PBO exclusions, mechanical/electrical limits).

     

  • Coverage conditions:

     

    • Available only when Company performs full packing (PBO excluded).

       

    • Items over USD $500 per item/set must be declared.

       

    • No single item may exceed 50% of total insured value.

       

    • Minimum insured value: $6/lb Actual Cash Value or $8/lb Replacement Value.

       

    • Deductibles apply (typically $250–$1,000).

       

    • Storage beyond 90 days requires premium extension.

       

  • Claims must be filed within 45 days of delivery directly with ITI (www.intertransins.com).

     

8.4 Exclusions (Applies to Liability & Insurance)

  • No liability/coverage for: cash, jewelry, passports, watches, collections, hazardous goods, narcotics, prohibited items, vehicles while self-driven, concealed PBO damages, wear & tear, climatic changes, infestation, sentimental value, or consequential loss.

9. Demurrage, Detention & Third-Party Charges

  • All port, terminal, rail storage, demurrage, detention, and unexpected third-party fees are for Client’s account, unless expressly included in writing.

10. Delivery, Inspection & Claims

  • Delivery is complete upon tender at the designated residence or in accordance with local practice.

  • Loss/damage must be noted before crew departs; concealed loss must be reported within 3 days.

  • Claims against Company must be filed within 1 year of delivery (or scheduled delivery date).

  • Insurance claims follow insurer’s 45-day filing rule (see Section 8.3).

11. Subcontracting & Route Liberty

Company may subcontract carriage, storage, handling, or delivery. Company and its agents may select routes, vessels, carriers, and methods, and may comply with any lawful authority’s instructions without constituting deviation.

12. Prohibited / Restricted Items

Client must not ship prohibited items, including but not limited to:

  • Cash, jewelry, negotiables, important documents

  • Firearms, ammunition, explosives, fireworks

  • Hazardous chemicals, gases, pressurized tanks

  • Narcotics or controlled substances

  • Live animals, perishables, untreated plants/soil

  • Alcohol, contraband, obscene or unlawful material

Violation may result in fines, seizure, or denial of coverage.

13. Privacy & Data Protection

Client authorizes Company to collect, use, and share personal information with carriers, agents, and government/customs authorities strictly for purposes of performing the move.

14. Lien

Company retains a general lien over all goods for unpaid charges, including prior shipments. After notice, goods may be sold to recover outstanding balances.

15. Governing Law & Jurisdiction

These Terms are governed by the laws of Ontario, Canada. Venue for disputes is Toronto, Ontario courts.
